Bringing Forward A Claim Under The Child Victims Act

According to the new Child Victims Act which became effective on Aug. 14, 2019, a small window of time was created for bringing claims where the time limits for taking legal action already expired years ago.  For these older claims you will have TWO YEARS, or until Aug. 14, 2021, to bring a claim for any past sexual abuse that you endured whether it occurred 20, 30 or 50 years ago. Even if you had previously made a claim in the past which was denied, you can now reopen the case under the Child Victims Act. However, you will only have until Aug. 14, 2021, to file your claim, so it is important to act fast and contact our sexual abuse attorneys right away.

This new statute applies to all perpetrators of sexual abuse, whether it be a pastor, coach, scout leader, or teacher. The organizations in which the perpetrators were affiliated can also be found financially responsible for your abuse. The Child Victims Act applies to any victim of sexual abuse who was under 18 years old when the abuse occurred.

These older claims require a substantial amount of investigation, so the quicker you can get us involved the better. If you are worried about your name being publicized, we can file your claim in a manner in which you remain anonymous. If you feel like you consented to the abuse, that does not mean you do not have a claim. Under the law you are incapable of consent until you are 18 years old. Consent by a minor is not a defense to sex abuse. THERE IS NO EXCUSE FOR SEX ABUSE!

Protecting Victims Of Boy Scout Abuse

For decades, the Boys Scouts of America has been an organization helping educate children with life lessons and a sense of discipline. But for as long as the organization has been in existence, there has been a history of sexual abuse and assault among its leaders that is just recently coming to light. Since the 1920s, the Boy Scouts have kept a long list of files that detail the horrific misconduct perpetrated by Scout leaders upon innocent children. These Ineligible Volunteer Files — otherwise known as the Perversion Files — have been released by the courts and are available to the public.

However, just because an abuser may not be on the list, that does not mean the abuse didn’t occur. If you or your child has been sexually abused as a member of the Boy Scouts, it is important that you speak to our Hamburg sex abuse attorneys right away. We offer a free confidential consultation, and we make sure that everything said to us is held in the strictest of confidence. We are here to support you and make sure that abusers and the organizations they belong to are held accountable and brought to justice.

Helping Clergy Abuse Victims Recover

Over the past few years, more and more claims of clergy abuse have been brought forward against the Buffalo Diocese. This has led to the uncovering of a long history of sexual misconduct within the Catholic Church among its priests and clergymen. Putting your faith in a religious leader only to have that trust abused is the ultimate betrayal, and the Hamburg sexual abuse attorneys at Chiacchia & Fleming, LLP, will not stand for it. It might seem wrong to bring a claim against a church, but if your human rights have been violated by a clergy member, this is not only morally just, but it is the right thing to do.

We understand that recovering reparations from the diocese will be a hard battle, but we want to fight it on your behalf. Our Hamburg sexual abuse attorneys are trial-ready and have a proven track record of protecting the rights of sexual abuse victims. If you or a loved one has been sexually abused by a priest at any point in your life, please contact us right away so as not to miss the statute of limitations. We will make sure your abusers, and anyone involved with covering it up or turning a blind eye, face the consequences of their actions.
