When someone’s involved in a car accident, the first major step is to make sure that your medical treatment is taken care of. Past that, you have a 30-day process to file what’s called a no-fault application with the insurance carrier that’s going to provide your no-fault benefits, whether it’s your vehicle that you were in or if you’re a passenger in someone else’s vehicle.If you’re involved in an accident with a government vehicle, you have to understand you have to file a notice of claim within 90 days with that municipality about the accident. Beyond that, in typical car accident cases, there’s a 3-year statute of limitations to actually file an action. With a municipality, it’s usually a year and 90 days; there’s a couple municipalities where it’s even a little shorter. That’s why you really need a lawyer involved early, to make sure that your rights are protected and you don’t mess up by not filing something timely. If you fail to file something timely, it could mean that your case never gets heard and you never get compensated for your injuries.
